Terms of Use

1. Acceptance of terms

By creating an account or using the Athly app (the "App"), you agree to these Terms of Use and the Privacy Policy. If you don't agree to these Terms, don't use the App.

Your acceptance is actively collected at account creation (checkboxes) and timestamped.

We may update these Terms to reflect the evolution of the App or the law. For any material change, you'll be notified in the App at least 30 days before it takes effect. Continuing to use the App after that date counts as acceptance; otherwise, you can close your account at no cost — and if you have an active paid subscription, you can cancel it before the change takes effect, with a prorated refund for the unused period.

The App is intended for people aged 16 and up (the App processes health data; this threshold follows GDPR article 8 in Europe and applicable laws). If you're between 16 and 18, parental or guardian consent is required.

2. Registration and account

Creating an account requires a valid email address and a password. The information you provide (age, weight, height, goals) must be accurate: it's used to personalize your calorie targets and your program.

• One account per person; the account is personal and non-transferable.
• You're responsible for keeping your credentials confidential and for any activity on your account.
• Notify us without delay if you suspect unauthorized use of your account.

We may refuse, suspend, or close an account created in violation of these Terms (see the Termination section).

3. Using the App

Athly gives you tools for training tracking (workouts, exercises, records), nutrition (log, meal plan, recipes, barcode scanning), progress (measurements, private photos, statistics), a personalized program, data sync, and limited community features (friend groups, leaderboards).

It is prohibited to:

• use the App for illegal or fraudulent purposes — including creating fake accounts or abusing the referral program;
• copy, decompile, disassemble, or reverse-engineer the App, or resell access to the service;
• upload illegal, hateful content, or content infringing on others' rights;
• disrupt the service's operation (deliberate overload, bypassing security measures, mass data extraction).

The App's names, brands, interfaces, text, and illustrations remain the property of the publisher. The data YOU save (measurements, photos, logs) remains yours — you only grant us the technical license needed to host it and display it to you.

4. Automatically generated content

Some features automatically generate content: personalized training programs and nutrition plans, automatic adjustments, conversational coach.

• This content is generated from your data and rules based on published scientific literature.
• It may contain errors, approximations, or recommendations unsuited to your specific situation. It's provided for informational purposes only and never replaces a professional (doctor, dietitian, kinesiologist).
• Suggested calories, macros, and loads are ESTIMATES. Always check plausibility before acting, and stop any exercise immediately if it causes pain.

5. Subscriptions and payments

The App offers a free tier and an optional Athly Premium subscription (monthly or annual).

• Free trial: Premium plans include a 7-day free trial. Without cancellation before the trial ends, billing starts automatically at the displayed price.
• Price and taxes: prices are shown in your local currency with applicable taxes for your region. The exact amount appears on the payment screen before confirmation.
• Auto-renewal: the subscription renews each period until cancelled. You can cancel anytime from your App Store or Google Play account settings; Premium access stays active until the end of the period already paid for.
• Payment: processed by Apple, Google, or our payment processor (RevenueCat). We never store your card number.
• Discount codes and referrals: stackable up to a maximum 25% discount; referral credit is subject to the anti-abuse limits shown in the App. Credits have no monetary value and are non-transferable.
• Refunds: except where legally required, already-billed periods are not refunded. Your applicable legal rights are not affected.
• Payment failure: access is temporarily maintained while you update your card; without resolution, the subscription ends at the due date.

6. Privacy and data

Full details on data collection and use are in the Privacy Policy. In short: we only collect what's needed to run the App, we never sell your data, and you can export or delete it anytime. Progress photos are private by default and never visible to other users.

7. Health disclaimer

Athly is NOT a medical device and provides NO medical advice, diagnosis, or treatment.

• Consult a doctor before starting a training program or changing your diet, especially if you have a medical condition, are pregnant, have an eating disorder, or take medication.
• Estimates (calories, 1RM, body composition, scores) rely on published formulas and carry an inherent margin of error.
• You engage in physical activity at your own risk. Stop any exercise if you feel pain, dizziness, or discomfort, and consult a professional.

To the extent permitted by law, the publisher's liability for any damage related to using the App is limited to the amount paid for the subscription over the past 12 months. The service is provided "as is", subject to legal warranties that cannot be excluded.

8. Termination

You can stop using the App anytime and delete your account in Profile → Account and privacy → "Delete account" (confirmation required). Deletion is permanent. You can also cancel just the Premium subscription without deleting your account.

We may suspend or close an account for serious violation of these Terms (fraud, referral abuse, illegal content, security breach); otherwise, we'll notify you first with 30 days' notice.

Personal account data is deleted within 30 days of closure. Unused referral credits and discount codes are forfeited when the account closes.

9. Governing law

These Terms are governed by the laws of the Province of Quebec and applicable federal laws of Canada. If any clause of these Terms is found invalid, the remaining clauses stay in effect.
